IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.791 OF 2024 Sunil Baban Wagh .. Petitioner Vs.

State of Maharashtra and Anr.

.. Respondents Mr. Satish R. Mishra for the Petitioner.

Mr. N.K. Rajpurohit, AGP for Respondent No.1-State of Maharashtra. Mr. Sarang S. Aradhye, with Ms. Gauri Velankar, Mr. Shantanu Gurav, Mr. Saarth Chordiya and Ms. Shruti Kothavade, for Respondent No.2. CORAM : A.S. CHANDURKAR & JITENDRA JAIN, JJ DATE : 12TH MARCH, 2024.

P.C. :

1.

In view of the fact that the petitioner was serving as Branch Manager at the respondent no.2-Society, which is registered under the provisions of the Maharashtra Co-operative Societies Act, 1960, and the petitioner seeks to challenge the notice of termination dated 12th January 2017 issued by the Society, the petitioner's remedy lies elsewhere. Writ Petition under Article 226 of the Constitution of India would not be maintainable against the said Co-operative Society in these facts. 2.

Hence, with liberty to the petitioner to avail appropriate remedy, this writ petition is not entertained. All points are kept open. [ JITENDRA JAIN, J. ] [ A.S. CHANDURKAR, J. ] 1/1 Dixit SNEHA ABHAY DIXIT by SNEHA ABHAY DIXIT Date:
