None for the applicant. None appeared for the respondent No.2 though served. The learned Additional Public Prosecutor is appeared for the respondent No.1/State. Perused the application for condonation of delay of 75 days in lodging an application for leave to appeal.

The applicant was original complainant. His complaint for offence punishable under Section 138 of the Negotiable Instruments Act, 1881 came to be dismissed by the learned trial Magistrate. He intends to challenge that Judgment and Order of Gaikwad RD 1/2

(29)APPLNNo.5542015 acquittal by preferring an application for leave to appeal. However delay has occasioned and the same is explained in paragraph 9 of the instant application which is on affidavit of the complainant.

In view of reasons stated in the application, delay in filing of application for leave to appeal is condoned. The application is disposed of accordingly.
