Considering the submissions made by the learned counsel for the Applicant, the averments made in the Application and order dated 19.01.2010, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Hearing of First Appeal no. 439 of 2008 is expedited.

b) Civil application stands disposed off accordingly.
