1] This is an application for modification of condition No.3 in the order dated 9th May 2014 passed in Bail Application No.346 of 2015.

2] By the said order dated 9th May 2014, the applicant was directed to be released on bail with a condition that after availing bail, the applicant shall attend office of Investigating Officer on every Sunday between 10.00 a.m. and 12.00 noon till conclusion of the trial.

3] Mr.Thakur, learned Counsel for the applicant submits that since his release from jail, the applicant has scrupulously followed

YBG appp741-15 the said condition. He further submits that the applicant has now joined a new employment and it is difficult for him to attend the I.O. on every Sunday. He, therefore, prays that appropriate orders may be passed, thereby relaxing the said condition. 4] Learned APP fairly submitted that the applicant has attended police station as directed by the said order. 5] In view of the above, I am inclined to allow the present application by modifying the said condition No.3. Hence, the following order:- (i) The applicant is directed to attend the office of I.O. on first Sunday of every month between 10.00 a.m and 12.00 noon, till the conclusion of trial, instead of attending the said office on every Sunday.

(ii) All other conditions imposed by order dated 9th May 2014 to remain the same;

(iii) Application is allowed in the aforesaid modification; (A.S.GADKARI, J)
