None for the Applicant. Dismissed for non prosecution. Later on; Mr. A. R. Patil, AGP for the Applicant mentioned the matter. Considering the submissions made by the learned AGP for the Applicant, earlier order is recalled. Matter is restored to file for hearing on merits.
By this Civil Application, the Applicants seek condonation of 1 year and 238 days delay in filing the Civil Revision Application for setting aside the conditional order passed by the learned Registrar.
The learned AGP submits that there was delay on the part of the concerned office to deposit the requisite amount of court fees in the office of the Government Pleader. He submits that Basavraj G. Patil 1/2
5.335.17-cac.doc they have good chance of success in the matter. He submits that if delay is not condoned, irreparable loss will be caused to them. Considering the submissions made by the learned AGP and the reasons disclosed in the Civil Application, I am satisfied that the Applicant has made out a case for allowing the Civil Application.
Hence, the following order is passed:
a.
Civil Application is allowed in terms of prayer clause (b) which reads thus:
"(b) That this Hon'ble Court be pleased to condone the delay of 1 year 238 days in preferring the above mentioned Civil Revision Application in First Appeal (ST) No.32303/2015."
b.
