Heard the learned counsel for the applicant and the learned APP for the State.

This application is preferred seeking pre-arrest bail in connection with C.R. No.109 of 2023 registered at Vasind police station for the offences punishable under section 408 read with 34 of Indian penal Code, 1860.

By an order dated 24th August, 2023 this Court had granted interim bail observing inter alia as under:- 6] On perusal of the first information report, it becomes evident that the principal accused Pravin had transferred the amount to the account of applicant as well as other persons. the persons to whose account the amounts were transferred. Undoubtedly, the matter warrants investigation. However, prima facie the involvement of the applicant seems to be that of a person into whose account the amount came to be transferred. The allegations are such that only a person who had access to the system of the bank can indulge in alleged offences.

The learned counsel for the applicant submits that the applicant has appeared before the investigating officer in terms of the aforesaid order and in the intervening period, the co-accused Pravin Bhoir, the husband of the applicant has been arrested. 5.

The learned APP on instructions confirmed the said fact. 6.

In view of the aforesaid development and having regard to the role attributed to the applicant, I am impelled to make the order of interim bail absolute.

The order of interim bail dated 24th August, 2023 is made absolute on the terms and conditions incorporated therein. 8.

In addition, the applicant shall regularly attend the proceedings before the jurisdictional Court.

It is clarified that these prima facie observations are confined to determine entitlement to pre-arrest bail only. ...2
