The applicant is apprehending his arrest in CR No. 1074 of 2022 registered with Malad Police Station, which invoke offence punishable under sections 380, 448, 454 of IPC. The learned APP on instructions of the Investigating Officer state, that the applicant is accused of opening the seal of the premises, which is in form of a floor mill. On subsequently realizing that he is the owner, the custodial interrogation of the applicant is not warranted. She however state that the applicant shall continue to render his co-operation to the investigating agency so that the Ashish Mhaske

2/2 914 ABA 2381.22.doc investigation can be concluded. Accepting the aforesaid statement the following order:- : ORDER :

(a) In the event of his arrest applicant - Niraj Manmohan Tripathi shall be released on temporary bail in connection with C.R.No. 1074 of 2022 registered with Malad Police Station on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount. (b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence. (c) The applicant shall mark his attendance to the concerned police station on 14/05/2022 and 15/09/2022 between 3:00 to 5:00 p.m and thereafter as and when required by the Investigating Officer.
