DATED : 3rd MAY 2023 P.C:- The second bail application deserve a rejection since on appreciating the evidence once again, I am perforced to arrive at the same conclusion, i.e. the applicant is the author of the injury recorded in column no. 19 of the postmortem report and this injury has been opined to be responsible for causing death of deceased Akshay Sonawane.

Apart from this, learned APP would submit that though the applicant is a young boy, he has four criminal antecedents to his credit in form of CRs registered with Wanwadi Police Station in the year 2017 and 2018. These CRs have invoked Section 394, 324, Section 384 along with Sections 452, 427, 504 of IPC and the relevant provisions of Maharashtra Police Act. In the wake of the aforesaid antecedents, the Ashish

2/2 32 BA-2695-22.doc argument of Mr. Joshi that he is a young boy do not appeal to my mind as being young, he has criminal antecedents to his credit. Apart from this, mere delay in conclusion of the trial can also not be a sole ground to be looked into, while releasing the accused on bail and particularly in this case, when he is attributed the blow on the head of the deceased, which has caused his death. Mr. Joshi has submitted that the charge has been framed recently in October, 2021 but there is no progress in the trial. In such circumstances, I deem it appropriate to direct the District Judge and Additional Sessions Judge, Pune to expeditiously proceed with Sessions Case No. 38 of 2019 and make every endeavor to expedite the trial by conducting the trial on day to day basis.

With the aforesaid observations, the application is rejected.
