The learned advocate appearing for the applicant points out the order dated 18th January 2017 passed by this Court in Criminal Bail Application No.933 of 2016 and submits that though this Court, while disposing of the earlier bail application had directed the learned Sessions Judge to make endeavour to expedite the trial, the trial is still not concluded.

The learned APP on instructions submits that the prosecution wants to examine six more witnesses out of which Kavita Page 1 of 3

four are official witnesses. The learned APP on instructions submits that within four months, the trial can be concluded as the prosecution is in a position to secure the presence of all the six witnesses immediately.

The statement so made by learned APP on instructions is accepted.

In this view of the matter, the learned advocate for the applicant states that the application may be disposed of by issuing suitable directions to the learned Trial Court. Therefore, the following order:-

ORDER

i) The application is disposed of with a direction to the learned Additional Sessions Judge to dispose of Sessions Case No.819 of 2015 pending on the file of learned Additional Sessions Judge Court No. 17, City Civil and Sessions Court at Greater Bombay, Mumbai within a period of 4 months from the date of communication of this order.

ii) The prosecution to keep their witnesses present on the date of recording of evidence given by the learned Additional Sessions Judge positively.

iii) Parties to act on an authenticated copy of this order. (A.M. BADAR, J ) Kavita Page 3 of 3
