Heard Ms Mudbidri, learned Counsel for petitioner and Mr. Railkar, learned Counsel for respondents No.1-A to 1-G and 5-A to 5-F.

Ms Mudbidri has tendered affidavit dated 22.01.2016 made by the petitioner setting out therein that as she has received Rs.50,000/- from - 1) Ramdas Nandkumar Narvekar, 2) Mahendra Nandkumar Narvekar, 3) Jitendra Nandkumar Narvekar, 4) Sugandha Chandrakant Manjarekar, 5) Santoshi Nandkumar Narvekar, and 6) Triveni, legal representatives of Nandkumar Tanaji Narvekar, she has no right, title and interest in the suit property and that she will not hereafter claim right, title and interest in the suit property. It is further stated that she also withdraws the objections raised to the Darkhast. It is further stated that she is not interested in prosecuting this Petition and wants to withdraw the Petition. Petitioner has also addressed a communication dated 29.01.2016 to her Advocate, Ms Mudbidri requesting her to withdraw the Petition. The affidavit as also the communication dated 29.01.2016 and acknowledgment are taken on record and marked 'X colly.' for identification.

Ms Mudbidri states that she has interacted with the petitioner, 1/2
WP1167_09.sxw who is present in the Court, and petitioner has reiterated that she does not want to proceed with the Petition. Even this Court has interacted with the petitioner wherein she confirmed the statements made in the affidavit.

In view thereof, on the motion made by Ms Mudbidri, Petition is allowed to be withdrawn. Rule is discharged with no order as to cost. (R. G. KETKAR, J.) Minal Parab 2/2
