The applicant herein has invoked jurisdiction of this Court under Section 482 of Cr.P.C. for quashing proceedings in RCC No.84 of 2009 pending on the file of Chief Judicial Magistrate of Daman. The records reveal that by an order dated 10th September, 2014, the learned CJM, Daman had dismissed the discharge application. The applicant herein had not challenged the said order. It is stated that charge has already been framed and the trial has also commenced. The present application for quashing is filed almost six years after filing of the proceeding.

Considering the above facts and circumstances, I am not inclined to exercise the powers under Section 482 of the Cr.P.C. 3.

Hence the application is dismissed.
