1] The Applicant was released on bail in the event of arrest in the subject CR which accuse him of offences under Section 406, 420, 465, 467, 468, 471 and 120-B of the Indian Penal Code registered with Kherwadi Police Station by order dated 03.02.2014. The protection was granted in his favour with the condition being imposed that, "He shall not leave India without the previous permission of this Court". Thereafter, it can be seen that on multiple occasions right from 13.02.2015, the Applicant preferred applications before this Court and on every occasion, permission was granted.

It can be seen that the Applicant has travelled on seven occasions.

(2)IA-3140-2022.doc 2] The learned counsel for the Applicant would submit that as far as present CR is concerned, though it was initially registered with Kherwadi Police Station, it was subsequently transferred to EOW which has recently filed supplementary charge-sheet. It can be thus seen that trial is not immediate foresight.

3] It is not the case of the prosecution that the Applicant is at flight risk and on seven occasions he was permitted to travel abroad. It is high time that condition of seeking permission to travel abroad from this Court every time, shall be relaxed.

4] In the wake of above, I deem it fit to relieve the Applicant of this condition, but he is directed to intimate the concerned Investigating Officer/EOW about his travel plan in advance supported by his itinerary and on his return he shall keep the Officer updated about his return. This condition will take the care of the apprehension of the Court while releasing him on bail that he may not be available for trial. 5] Interim Application is allowed in the aforesaid terms.
