The accused is charged for the offences punishable under Sections 115 read with sections 302, 120 (B) of Indian Penal Code, Section 3, 25 of Arms Act and Section 3(1)(ii), 3(2), 3(4) of the M.C.O.C. Act.

The applicant is in custody since 6th April, 2015. While disposing of application preferred by co accused, this Court by order dated 8th November, 2017 had directed the trial Court to make endeavour to frame charge not later than 30th December, 2017. The prosecution has examined two witnesses. 3.

Considering the fact that the applicant is in custody since the date of arrest and the trial has now commenced. The applicant is

Applicant is allowed to withdraw this application with liberty to the applicant to prefer fresh application in the event trial is not concluded within six months from today.
