P.C.:
Heard the learned counsel. The Respondent No.2 - wife has filed the proceedings under sections 498A, 406, 323, 506 r/w 34 of IPC and on that basis charge sheet has been filed and Criminal Case No.147 of 2016 has been registered.
The learned counsel for the petitioner husband in Writ Petition No.3023 of 2016 and for in laws in other petition submits that in earlier proceedings the respondent - wife has made some statements and those statements run contrary to FIR.
pmw 2/2 wp-3023, 3024.16.doc The learned APP appearing for State submits that grievance of this nature can be looked into by the trial Court. Whether statements are contrary, what is the relevance of such statements are aspects required to be looked into by the trial Court. We are therefore not inclined to make any observation in that respect in present jurisdiction.
Liberty to petitioners to take steps as are open to them in law are kept open. Petitions are disposed of accordingly. (SADHANA S. JADHAV, J.) (B. P. DHARMADHIKARI, J.)
