At the outset, learned counsel for the Respondent No.1. submits that the applicant had filed an identical application in this Court seeking identical prayers in Criminal Revision Application No.540 of 2017, against the very same order dated 27th July, 2017, passed by the learned Special Judge, SEBI Special Court, City Civil and Sessions Court, Greater Bombay in Special SEBI Special Case No.428 of 2014, which is impugned in this application.

Learned Counsel has placed on record the order dated 13th December, 2017, passed by this Court (Coram:A.S.Gadkari,J.) in Criminal Revision Application No.540 of 2017, which reads thus:- "1. After hearing the learned Counsel for the applicant at length, when this Court was not inclined to grant any relief, the learned Counsel on instructions seeks leave to withdraw the present application unconditionally.

Leave granted.

Application is dismissed as withdrawn."

Learned Counsel for the Respondent No.1 has also placed on record a copy of the aforesaid Criminal Revision Application No.540 of 2017. The same is taken on record. The prayers sought in the present application are identical to the prayers made in Criminal Revision Application No.540 of 2017.

Considering the order passed in Criminal Revision Application No.540 of 2017, the present application cannot be entertained and is accordingly dismissed.
