This is an application for bail filed by the aforesaid applicant who is facing trial in Sessions Case No.519 of 2012, arising from Crime No.162 of 2012 2.

Heard Mr. Joshi, the learned counsel for the applicant and Mr. Adsule, the learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsels for the respective parties. The report received from the Addl. Sessions Judge, Pune reveals that all the witnesses are examined. The learned APP for the State submitted that the statement under Section 313 of Cr.P.C. has already recorded and the case is pending for final

jsn 21 BA No.1695_2015 argument on 14th March, 2016. Since the case is at the fag end, I do not find it expedient to exercise the discretion under Section 439 of the Cr.P.C.

Hence the application is dismissed.
