This is an application received through Jail. The applicant has stated that he was arrested on 30.11.2010 by Malvani Police Station in CR No.315/2010. After completion of investigation, it was culminated into Sessions Case NO.50/2011. The applicant has stated that the trial pertaining to CR No.315/2010 i.e. Sessions Case No.50/2011 has not yet commenced and he is languishing in Jail as pre-trial prisoner. He therefore, has prayed that either he my be released on bail or his trial may be expedited. The Learned APP, on instructions, submitted that the trial in Sessions Case No. 50/2011 has already began and the recording of evidence of the complainant is complected. She, on instructions, further submitted that the next date is 22.2.2016.

2) As the applicant is arrested on 30.11.2010 and since then he is in Jail, the Trial Court seized of the Sessions Case No. 50/2011

2 /2 arising out of CR No.315/2010 registered with Malvani Police Station, Mumbai is hereby directed to conclude the said trial before 31.12.2016. The Trial Court shall take all necessary steps in procuring the presence of the witnesses and the accused. This direction is issued in view of the fact that the applicant is languishing in Jail for last more than five years. Application is allowed in the aforesaid terms.
