ORDER:- Earlier, the Petitioner was issued notice dated 2.3.2016 under the provisions of Sections 376, 392 and 468 of the Maharashtra Municipal Corporation Act for carrying out business in the suit premises without obtaining licence. It is not disputed that the Petitioner did not apply or obtain licence for carrying out business and hence, by notice dated 26.8.2016, which is impugned in the present petition, the Petitioner has been called upon to stop the business 1/2

Shivgan 2 913-WP-101762016.sxw carried out in the suit premises. We are of the opinion that the Petitioner cannot continue business in the suit premises without obtaining licence. We, therefore, do not find any merit in the Petition and the same is, accordingly, dismissed.
