This is an application for condonation of delay of 17 days in filing his application for restoration of the revision application as well as for restoration of the revision application. avk 1/2
39-APPR-504-2016.doc Heard the learned counsel for the applicant, the learned APP and the learned counsel appearing for respondent no.2.
For the reasons stated in the application, interest of justice would meed if the revision application is restored and prejudice caused to the State can be compensated in terms of money. Hence the following order :
i) The delay of 17 days in filing the application for restoration is condoned and the application for restoration of the revision application is allowed, subject to payment of costs of Rs.2,000/- to the State, within a period of 15 days from this order.
ii) If the costs so imposed is paid, revision application be restored to file.
