2/2 19 ABA-2416-22.doc When the Investigating Offcer is asked about his inference, on the basis of the interrogation of their involvement in the crime and need for their custodial interrogation, learned A.P.P. states that no such reasons are recorded.

The Investigating Offcer is expected to abide by the mandate of Section 41A of Cr.P.C.. In case, if he is desirous of effecting the arrest, he shall record his reasons in writing and serve an advance notice of 72 hours on the applicants in such contingency.
