Heard learned counsel for the applicant and learned APP.

This is an application for bail through jail in respect of C.R.No. I-330 of 2016 registered with Mumbra Police Station for the offence punishable under sections 302, 506(2), 504, 34 of the Indian Penal Code, 1860. 3.
4 accused assaulted the victim. 2 accused have been released on bail. So far as the applicant is concerned, the role attributed to him is that he stabbed the victim in chest with a knife. The victim died. There are eyewitnesses. They say that it is the applicant who stabbed the deceased. 1/2

4. ba 2429.22.doc The applicant is in custody for 6 and 1/2 years pursuant to his arrest on 16/07/2016. The applicant was once released on temporary bail on account of death of his mother. There is nothing to indicate that the applicant misused his liberty. Learned APP pointed out that the trial has commenced and the complainant has already been examined. Taking an overall view of the matter, it would be appropriate in my view to expedite the trial. There are 31 witnesses who are cited. Learned APP submits that not all of them will be examined. Learned trial Court is requested to conclude the trial preferably within 9 months from the date on which this order is placed on record before it. Liberty to file a fresh application for bail if the trial is not concluded by then. 4.
The bail application is disposed of.
