The learned counsel for the Appellant-National Insurance Company Limited states that he has instructions to withdraw the Appeal. Accordingly, the Appeal is allowed to be withdrawn.

In view of the withdrawal of the Appeal, nothing survives for consideration in the Interim Application and Civil Application. The Interim Application and Civil Application are disposed of accordingly.

The amount of Rs.25,000/- which is deposited in this Court at the time of filing of the Appeal in terms of Section 173 of the Motor Vehicles Act, 1988 be transferred to the Motor Accident Claims Tribunal, Mumbai. The claimants are permitted to withdraw the amounts which have been deposited before the Tribunal to the extent of their respective shares.
