learned Counsel appearing for the Petitioner seeks leave to withdraw the writ petition with liberty to approach the trial Court under section 319 of the Code of Criminal Procedure, 1973. Leave with liberty as prayed for is granted. Writ petition is allowed to withdrawn and is dismissed as such. 2.

It is made clear that in the event Petitioner files an application under section 319 of the Code, the trial Court shall decide the same independently on its on merits. All points and contentions are kept open.
