This is an application under Section 439 of the Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No. 179 of 2022 registered at Shikrapur Police Station, District Pune, for the offences punishable under Sections 354(D), 504, 506 of the Indian Penal Code and Section 12 of the Protection of Children from Sexual Offences Act (in short POCSO Act).

I have heard the learned counsel for the applicant, the learned APP for the State and the learned counsel for respondent No.2. 4.

The allegations interalia are of stalking. The applicant is in A. J. Vallakati 1/2

2/2 30-BA-2422-22.doc jail for more than six months. There are no other criminal antecedents. Considering these facts and circumstances, I am inclined to release the applicant on bail on certain conditions. In the result, the following order is passed:

O R D E R

A] The Bail Application is allowed.

B] The applicant be released on bail in Crime No. 179 of 2022 registered at Shikrapur Police Station, District Pune, for the offences punishable under Sections 354(D), 504, 506 of the Indian Penal Code and Section 12 of the POCSO Act, on furnishing P.R. Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C] The applicant shall not enter into the limits of Taluka Shirur, till conclusion of trial and shall seek permission of the trial Court in case for any reason he is required to enter into the limits of said Taluka.
