Heard Mr. Sakhare, the learned Senior Counsel appearing for the Petitioner and Mr. Shetye, the learned Counsel appearing for the Election Commission. By these petitions, the Petitioners are challenging the formation of wards of Mahabaleshwar Municipal Council. The draft for delimitation of wards of Mahabaleshwar Municipal Council was published by the Collector on 5th July 2016. By this notification, objections were called for from the citizens upto 14th July 2016. The Petitioners accordingly submitted their objections on 14th July 2016. The Collector along with his patilsr 1 / 2

recommendations sent these objections to the Commission. The Commission considered all the objections and ultimately overruled these objections. Thereafter final notification of delimitation of wards was published on 10th August 2016.

Admittedly, by the notification dated 17th October 2016, the election commission has issued election notification for Mahabaleshwar Municipal Council. According to this notification, the election programme has commenced from 19th October 2016. 3.

In the light of above, we are not inclined to entertain these writ petitions under Article 226 of the Constitution of India and the same are accordingly dismissed.
