IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO.3483 OF 2018 Gurmitsingh Harvinder Singh

...Petitioner

vs.

The State of Maharashtra

...Respondent

---- Mr. Veerdhaval Deshmukh for the Petitioner.

Smt. Aruna S. Pai, APP for the Respondent/State. ---- CORAM : B. P. DHARMADHIKARI & SMT. S. S. JADHAV, JJ.

DATE : 18/11/2019.

P.C.:

.

Heard learned counsel (appointed) for the petitioner and learned APP. The Petitioner claims remission under remission scheme floated on account of 125th Anniversary of Babasaheb Ambedkar. 2.

Learned APP pointed out that the petitioner is convict under NDPS Act and in terms of policy decision dated 3/6/2017 as explained later, since he is convict under Central enactment, he is not entitled to benefit thereof.

3.

We have perused notification. NDPS convict does not appear to be eligible for grant of remission. The petition is therefore rejected. 4.

Order be communicated to the prisoner in jail. (SMT. S.S. JADHAV, J.) (B. P. DHARMADHIKARI, J.)
