Heard learned Counsel for the applicant on this application for early hearing.

The applicant is convicted for the offence punishable under Section 376 of IPC and sentenced to suffer RI for seven years. He is also convicted for the offence punishable under Section 4 of the Protection of Children from Sexual Offences Act and sentenced to suffer RI for seven years. His appeal is already admitted on 13.7.2015. His application for bail was already rejected by this Court. The applicant is apparently in custody 1 / 2

8.APPA.1087-15.doc since the pronouncement of the judgment of conviction as earlier he was granted bail during pendency of trial. The judgment and order is passed on 4.3.2015.

There is no special ground for taking up the appeal for expeditious hearing as the conviction is for seven years and the applicant is taken in custody sometime in March, 2015. During trial, his custody was only for ten months. Present application therefore has no merit and the same is accordingly dismissed. Matter to come up in its usual course for final hearing. ( A. R.
