Applicant is seeking pre-arrest bail in Crime No.214 of 2021 registered with Mira Road Police Station for the offence punishable under Sections 420, 504, 506 of IPC. 2.
The allegation against the applicant is after having received consideration failed to honour the commitment of promise of executing title deed in relation to the immovable property. 3.
On last occasion i.e. on 16th November, 2021, counsel for the applicant on instructions has undertaken to deposit amount of Rs.16,50,000/- within a period of two weeks and as such this Court granted ad-interim protection. Thereafter when the matter was listed on 30th November, 2021, counsel for the applicant further BGP.

assured that an amount of Rs.5,00,000/- will be deposited out of aforesaid amount by next date i.e. on 1st December, 2021 and balance amount of Rs.11,50,000/- by 13th December, 2021. 4.
Today, when the matter is called out, counsel for the applicant submits that an amount of Rs.2,00,000/- will be deposited today and balance amount within two weeks.

The aforesaid conduct of the applicant is nothing but taking the order for granted. Applicant had made voluntary statement before this Court while getting ad-interim protection from this Court and has violated the interim protection without any condition.

Applicant's involvement in the offence can be inferred as amount of Rs.16,00,000/- has been received by the applicant from the account of the complainant in his bank account. 7.
That being so, necessary ingredients are satisfied so as to infer prima-facie involvement of the applicant in the crime. 8.
No case for bail is made out.

As such, application stands rejected.
