The second respondent is duly served. Delay is of one year and sixty days in preferring appeal for challenging the Judgment and Award in a reference under the Land Acquisition Act,1894. In fact, the State Government (first respondent) has also preferred an appeal against the same Judgment and Award. Hence, delay deserves to be condoned. Accordingly, rule is made absolute in terms of prayer clause (a).
