1) By an Order dated 21st August 2017, the applicant was granted interim relief.
2) Perused the record and it prima facie indicates that, no specific role is attributed to the applicant in the present crime to infer that the applicant inflicted grievous injuries. It further appears that in pursuance of Order dated 21st August 2017, the applicant has attended the Investigating Officer and co-operated in the process of investigation. The record further indicates that the sword i.e. weapon used in the present crime has been recovered at the instance of co-accused Anand Rathod. As there is no specific overt-act attributed to the present applicant and since there is no recovery to be effected at his instance, in my view, the custodial

3) In view thereof, interim relief granted by Order dated 21st August 2017 is hereby confirmed. However, the applicant shall attend the Investigating Officer as and when called for between 10.00 a.m to 12.00 noon till submission of chargesheet.
