This petition is filed by the Gram Panchayat against the Zilla Parishad and the State Government challenging the Government Resolution dated 24 June 2022 in respect of shifting of Primary Health Centre from village Karak to village Karavali. Considering the fact that the Petitioner- Gram Panchayat is a local body constituted under a statute and the dispute is being raised against the Zilla Parishad, the another local body and the State Government, the litigation at the behest of the Gram Panchayat in the Court should be the last resort. However, it appears that the Petitioner- Panchayat has directly filed writ petition without making

skn 2 24-11638.2022.doc any effort to approach the Zilla Parishad or the State Government with its grievance. The establishment of a Public Health Centre and the matter of public health are also the concerns of the State Government and the Zilla Parishad and not only of the PetitionerGram Panchayat. The funds are also allotted by the State Government.

The learned counsel for the Petitioner, on instructions, states that the Petitioner will approach the State Government in respect of GR dated 24 June 2022 and put forth its version for reconsideration of the decision and thereafter exploring the avenues as may be available in law to the Petitioner. 3.

With the above observation, writ petition is accordingly disposed of.
