The applicant is seeking bail in CR No.229 of 2013 registered with Rabodi Police Station,Thane. The investigation in the present crime is completed and the charge sheet has been filed on 11.6.2014.
2) Learned counsel for the applicant submitted that the co accused namely Sachin Subhash Kamble who has been attributed with the similar role has been released on bail by this court by order 2.12.2014. I have perused the FIR, other documents and charge sheet annexed to the application. As per the FIR and the statements of the witnesses the role attributed to the present applicant is that he threatened the people gathered on the spot with a sword. This is the only differentiating aspect of role from other co accused namely Sachin Kamble @ Sachin Kanya. The other acts which are attributed to Sachin Kamble are similar to the present applicant. In that view of

2 /2 BA-1708-2015 the matter the applicant is entitled for bail on the ground of parity with accused Sachin Kamble. The applicant has made out a case for grant of bail. Hence, the following order.
ORDER
a) The applicant be enlarged on bail in CR No.229/2013 registered with Rabodi Police Station,Thane on his furnishing PR bond of Rs.15,000/-with one or two solvent sureties in the like amount. b) After his release from Jail the applicant shall report to Rabodi Police Station, Thane on first Sunday of every month between 10.00 and 12.00 noon till the conclusion of the trial. c) The applicant shall give his documents of residential address along with phone no. to the Rabodi Police Police Station, Thane. d) The applicant shall not tamper with and/or influence the prosecution witnesses.
