The Applicant, apprehending his arrest in connection with the investigation of Crime No. 1198 of 2021 registered with Chakan Police Station, Dist. Pune under Section 328, 272, 273, 288 read with Section 34 of I.P.C. is seeking pre-arrest bail. 2.

I have heard the learned counsel for the parties. 3.

A perusal of the FIR dated 1/2 October 2021 by Anil Mahajan, who is a Police Naik attached to the Social Service Branch at Pimpri-Chinchwad, Pune shows that only allegation against the Applicant Arun Ingawale is that he had made available a room on the ground floor of the building, abutting to Sneha Chavan page 1 of 2

23 aba 2557-21=.doc the staircase for storage of tobacco products to the co-accused. The perusal of the FIR does not show that there is any allegation that the Applicant was actively involved in the storage or sale of any such tobacco products which are prohibited or banned. The record also shows that the interim protection is in favour of the Applicant since 26.10.2021.

In such circumstances, the following order is passed:

ORDER

i) In the event of his arrest, in connection with the investigation of Crime No. 1198 of 2021 registered with Chakan Police Station, Dist. Pune, the Applicant shall be released on bail on executing a PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

ii) The Applicant shall report to the Investigating Officer as and when required by the Investigating Officer. iii) The applicant shall co-operate with the Investigating Agency and shall not tamper with the prosecution evidence/witnesses.

The criminal application is disposed of in the aforesaid terms.
