Ms Sonal states that petitioners have participated in the auction. Mr. Chipte for respondent no.1 agrees with Ms Sonal and we are informed that petitioners are the only bidders. Mr. Chipte further states that petitioners' offer is acceptable to respondent no.1 and is accepted by respondent no.1 and they shall go ahead and conclude the sale. Mr. Yewale for respondent no.2 also states they have no objection.

In view of the above, Ms Sonal seeks leave of the court to withdraw the petition with liberty to take such action as advised against respondent nos.2 and 3 to claim damages / other reliefs. All rights and contentions of respondent no. 2 and 3 are also kept Meera Jadhav
