The Petitioner is raising dispute which relates to the service with the Union of India.

The law is settled as far back in the year 1997 by the decision of the Constitution Bench of the Supreme Court in L.Chandra Kumar v. Union of India1 that for the service dispute with the Union of India, the court of first instance is an Administrative Tribunal and, therefore, the High Court should not entertain the petition directly in respect of the same. The Petitioner has not challenged the order of the Central Administrative Tribunal. The counsel for the Petitioner states that the Petitioner has crossed the age of superannuation. If the grievance of the Petitioner still remains and if any relief is to be sought, it is open to the Petitioner to approach the Tribunal, subject to delay etc.

Writ petition is accordingly disposed of.
