Applicant is seeking pre-arrest bail in Crime No.185 of 2022 registered with Adgaon Police Station, Nashik for the offence punishable under Sections 406 and 420 of IPC. 2.

The applicant has admittedly taken custody of the vehicle from the complainant and as such was duty bound not only to repay the loan amount but also co-operate the complainant in honouring the hire purchase agreement which he has failed to. Neither the said amount is paid nor the vehicle is returned. As such, necessary ingredients of offence punishable under Sections 406 and 420 of IPC is made out.

The application as such fails, rejected.
