By this application under Section 438 of Cr.P.C., the applicant seeks pre-arrest bail apprehending his arrest, in Crime No.673/2020, registered with Deccan Police Station, Pune, for the offences punishable under Sections 406, 409, 420, 464, 465, 467, 468, 471, 474, 477-A, 120-B, 225 r/w 34 of the IPC and Section 3 of MPID Act.

This Court by an order dated 25.10.2021, after hearing learned Counsel for the applicant and learned APP, granted ad-interim protection to the applicant from arrest which continued thereafter till 16.06.2022. 3.
On the last date, Mr.Gaikwad, learned APP submitted that Mr.Pravin
Chavan has been appointed as a Special Public Prosecutor, however, he was unable to attend the Court due to personal difficulty. Even today, Mr. Gaikwad submits that Mr. Chavan is in personal difficulty. Nevertheless, the Investigating Officer, PI Sucheta Khokale, EOW, Pune, who is present in the Court, categorically submits that the Chargesheet has already been filed and custodial interrogation of the applicant is not required. 4.
Mr.Nikam, learned Counsel for the applicant has invited my attention to an order of the Supreme Court passed in Special Leave to Petition (Criminal) 9584/2021 by which one of the co-accused viz. Sunil Zawar has been directed to be released on bail on such terms and conditions as the trial Court may deem appropriate to impose upon the petitioner. Said order is taken on record and marked 'X' for identification. 5.
In view of the above facts, the application is made absolute in terms of prayer clause (a).

In the event of his arrest, the applicant be released on bail, on executing a P.R. Bond, in the sum of Rs.50,000/- with one or two sureties in the like amount, to the satisfaction of the Special Court, Pune. 7.
Eventhough, Chargesheet has been filed, the applicant shall attend E.O.W. as and when summoned in order to carry out further investigation into the matter looking to the nature and gravity of the offences. 8.
The application stands disposed of.
