MONDAY, 28 th SEPTEMBER, 2015 P.C. :
1.
By this application, the applicant seeks modification/relaxation of the condition of attendance imposed by this Court (Coram : Abhay M. Thipsay, J.), vide order dated 3rd October, 2012, whilst enlarging the applicant on bail. The relevant part of the condition of which modification is sought reads thus:
" ..........................., on the condition that she shall report to Dhankavdi Police Station, Pune, on every Sunday, till the disposal of the case against her."
1/4
2.
Learned Counsel for the applicant states that pursuant to the said order dated 3rd October, 2012, the applicant has been attending the Sahakar Nagar Police Station on every Sunday. She submits that although the direction was to report to Dhankavdi Police Station, there is no Dhankavdi Police Station but it is Dhankavdi Police Chowki and hence, the applicant was asked to report to Sahakar Nagar Police Station by the concerned Officer. She submits that the applicant is a student of Yashwantrao Chavan Law College, Pune and is studying law in the said College. She submits that charges have been framed and the trial has commenced.
3.
Learned A.P.P does not dispute the fact that the applicant has been attending the concerned Police Station on every Sunday as directed vide order dated 3rd October, 2012. She has no objection if the above condition is modified/relaxed to the above extent. She makes this statement on the instructions of the Officer, who is present in Court. 4.
This Court had earlier relaxed a similar condition imposed by the Court on the applicant with regard to the attendance. Considering that 2/4
the applicant has been attending the concerned Police Station from October 2012 till date, and the fact that charge has been framed and the trial has commenced, the said condition is modified from attendance to the concerned Police Station on every Sunday to that of the first Sunday of every month.
5.
The application is disposed of accordingly.
