This is an application under Section 439 of Cr.P.C. for bail in C.R. No. I-113 of 2016 registered with Talasari Police Station, District Palghar under Sections 419, 420, 465, 467, 468, 471 read with Section 34 of the Indian Penal Code and under Sections 81, 82(A), 2(D) and 83(I) of the Indian Registration Act. Heard the learned Counsel for the Applicant and the learned APP. Perused the charge-sheet.
The learned Counsel for the Applicant submitted that co-accused Sameer Rafiq, who has been attributed with same and/or similar role, has been released on bail by this Court by its order dated 10.07.2017 and therefore, the Applicant is entitled to be released on bail on the ground of parity. After perusing the record, this Court is of the view of the Applicant has been attributed with the same and/or similar role as that of co-accused Sameer Rafique who has been released on bail by an Order dated 10.07.2017 and therefore, the Applicant can be released on bail on the ground of parity. Hence, the following order:
i) The applicant be released on bail in CR No. I-113 of 2016 registered with Talasari Police Station, District Palghar on his furnishing PR bond of Rs.30,000/- with one or two solvent local sureties in the like amount. ii) After his release from jail, the applicant shall attend the concerned Police Station on every first Monday of the month between 11.00 a.m. to 1.00 p.m.
iii) The Applicant shall furnish his residential address and mobile phone number to the Investigating Officer.
iv) The applicant shall also attend all the dates before the Trial Court. v) The Applicant shall not tamper with the evidence and/or pressurize or threaten the prosecution witnesses.
