Heard learned counsel for the applicant and the learned APP for the respondent - State. 2.

By this application, the applicant seeks relaxation/modification of the condition of attendance imposed by this Court (CORAM : ABHAY M. THIPSAY, J.) vide order dated 31.01.2013, to the extent that it directs the applicant to attend the Kondhwa police station,

Pune, on every Sunday, till the disposal of the case against him.

Learned counsel for the applicant submits that the applicant has been regularly attending the Kondhwa police station, Pune pursuant to the directions of this Court and has also been attending the Special Court on every date of hearing. She submits that the applicant is pursuing LLB at the Yashwantrao Chavan Law College, Pune. She submits that this Court has relaxed/modified the condition of attendance to the police station qua some of the co-accused and relies on the said orders.

The investigating officer for the ATS, who is present in Court has no objection, if the said condition is modified/relaxed and the applicant is directed to attend the Kondhwa police station, Pune on the first Sunday of

every month between 10.00 a.m. to 12.00 noon instead of every Sunday between 10.00 a.m. to 12.00 noon.

For the reasons set out in the application, the Application is allowed. The applicant shall, now, attend the Kondhwa Police Station, Pune on the first Sunday of every month between 10.00 a.m. to 12.00 noon instead of every Sunday between 10.00 a.m. to 12.00 noon, till the conclusion of the trial.

Accordingly, the Application is disposed of.
