Heard the learned counsel for the applicant. None appears for the respondent no.1 when called out. I have gone through the application and the counteraffidavit on behalf of the respondent no.1. Considering the averments made in the application, and the period spent by the applicant in prosecuting an Appeal against the impugned order in the Court of Sessions, I am inclined to condone the delay.
