IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO. 1526 OF 2016 Office Notes, Office Memorandam of Coram, appearances, Court's orders or directions and Registrar's orders Court's or Judge's orders Mr. Arun Rajput i/by Anjali Patil for the Applicant. Mr.R.M.Gadhvi, APP .for the State.
CORAM : A.S.GADKARI, J.
DATE : 31st August, 2016 P.C.
This is second anticipatory bail application by the applicant. The earlier Anticipatory Bail Application NO.693/2016 was dismissed on merits by the co-ordinate Bench (Smt. M. R.Bhatkar, J.) by its order dated 4.5.2016. The learned counsel for the applicant submitted that, after the dismissal of the said anticipatory bail application the parties herein have settled the matter and that is the change in circumstances. I am unable to accept the said contention. The earlier bail application was decided on merits. According to me there is no change of circumstance. It is surprising to note that the Investigation Officer has not taken any steps in furtherance of the order dated 4.5.2016. Be that as it may, according to me there is no change in circumstance in facts situation of the case. The application is misconceived and the same is dismissed. (A.S.GADKARI,J.)
