The applicant is apprehending arrest in CR No. 113/2014 registered with Malbhar Hill Police Station under Sections- 419, 420, 467, 468, 471 of the of the Indian Penal Code.

It is the allegation against the applicant that the applicant by making false representation to the informant accepted a sum of Rs.3,58,488/- for giving air tickets and submitted invoices of the said amount to the informant and gave bogus air tickets to her. 3.

During the course of arguments the learned counsel appearing for the applicant submitted that the father of the applicant is present in the Court and ready and willing to deposit the said Rs. 3,60,000/- i.e. the said alleged defalcated amount in the registry of this Court. That an amount of Rs.1,30,000/- will be immediately and the balance amount of

2/3 Rs.1,30,000/- will be deposited by the applicant within a period of three months from his actual release from Jail. The said statement is accepted. In view of the statement made by the applicant and without going into the merits of the matter I am inclined to release the applicant on bail. In the present crime the applicant is arrested 1.10.2016 and since then he is in Jail.

In view of the above submission, the applicant can be released on bail.

Hence, the following order.

(i) The applicant shall be released on bail in CR No. 113/2016 registered with Malbhar Hill Police Station, Mumbai on his furnishing PR bond of Rs. 25,000/- with one or two solvent local sureties in the like amount.

(ii) Before his release from Jail the applicant shall deposit a sum of Rs. 1,30,000/-in the registry of this Court. The deposit of the said amount shall be the condition precedent from actual release of applicant from Jail.

(iii) After his release from Jail the applicant shall deposit the remaining amount of Rs.1,30,000/- within a period of three months from the date of actual release from Jail.

(iv) If the applicant fails to deposit the balance amount within the aforesaid period, his bail shall stand cancelled without further reference to the Court.

3/3 (v) After his release from the jail, the applicant shall attend the concerned Police Station on every 1st Monday of the month between 10.00 a.m. to 12.00 noon till the conclusion of trial. (vi) The applicant shall also attend all the dates before the trial Court. (iv) The applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
