The petition is filed for the following reliefs : "(a) This Hon'ble Court be pleased to issue Writ of Mandamus and/or such order to the concerned police officer of Vile Parle Police Station, Mumbai, to file final report/charge sheet in F.I.R. No.140 of 2017 as early as possible.

(b) This Hon'ble Court be pleased to give direction to the concerned Police Officer of Vile Parle Police Station, Mumbai, to take appropriate and vigilant action against the Accused No.2-Atut Gopal Pathak at earliest;" Shubhada S Kadam 1/2

8 wp 3500.18.doc So far as relief claimed in prayer clause (a) is concerned, learned APP makes a statement that the charge-sheet in the subject FIR is filed on 10th October, 2018. In view of the statement, the relief claimed in the said prayer is rendered infructuous.

As far as relief claimed in prayer clause (b) is concerned, learned APP makes a statement that, on investigation, no material is found against the accused No.2 - Atul Gopal Pathak and, therefore, he is not arraigned as accused. In view of the statement, the relief claimed in prayer clause (b) also cannot be granted.
