This is an application, through jail, seeking enlargement on bail for expediting the matter.

It appears that the applicant herein is arrested on 21st October 2011 and is charge-sheeted in Crime No.173 of 2011 for the offences punishable under Sections 302, 397 and 449 of Indian Penal Code.

Learned APP, upon instructions, submits that the trial has commenced and the Sessions Court has recorded substantive evidence of more than three witnesses.

In view of this, it would not be appropriate to consider the Pg 1 of 2

23.ba.1785.2016.doc application for enlargement on bail under Section 439 of the Code of Criminal Procedure, 1973 at this stage. Hence, the application stands disposed of.
