1) Heard rival arguments on this application for bail and the suspension of substantive sentence during the pendency of the appeal. Today the appeal is admitted.

2) The applicant/original accused no.2 is convicted for the offences under section 7 and 13 (1)(d) read with section 13 (2) of the Prevention of Corruption Act,1988 and on each count he is sentenced to suffer RI for one year and to pay fine of Rs.5,000/-, in default of payment of fine SI for two months on each count. Reportedly, fine amounts are already paid. During the trial, the applicant was on bail. Even after conviction he has been released on 1/2

3-APPA-1089-2015.doc bail till filing of the appeal. The applicant/original accused no.2 be released on same bail as granted by the trial Court with fresh bonds to be executed before the trial Court. The substantive sentence is suspended till conclusion of the appeal. This order will be effective only after depositing of the fine amount in the trial Court. 3) Application is accordingly disposed of.
