This is an application for relaxation of condition imposed upon the applicant by this Court while releasing him on bail by Order dated 5.5.2016 passed in Bail Application No.931/2016. The condition No. (iv) reads as under:

"The applicant shall not stay in the same locality where the complainant is residing and shall stay at Girgaum or some other place".

The applicant is an accused in CR No.87 of 2016 registered with Charkop Police Station, Mumbai under Sections 376, 354(C), 384, 506(1), 509 of the Indian Penal Code. This Court while releasing the applicant on bail after taking into consideration the various attending circumstances and the gravity of the offence has imposed the said condition. I do not find any merit in the present application for relaxing the said condition, as the said condition has been imposed in view of the facts and circumstances of the case.

Application is accordingly rejected.
