Learned APP on instructions states that the trial has commenced, inasmuch as, the first witness is in the witness box. Learned APP on instructions further states that the prosecution intends to examine about 12-13 witnesses.

Since the trial has commenced, it would not be appropriate to consider the Application on merits. Accordingly, the Application is rejected. However, the trial of the Applicant is expedited. Learned Judge to dispose of the case as expeditiously as possible and preferably within nine months from the date of receipt of this order.
