The petitioner is charge-sheeted for an offence punishable under Sections 353, 323, 504 of IPC in Crime No.63 of 2021 registered with respondent Nos.2 and 4 pursuant to complaint lodged by respondent No.1.

The petitioner also lodged a complaint of assault against respondent No.1 with respondent Nos.2 and 4 of which an NC was given to the petitioner on 13th May, 2021.

In the aforesaid background, the prayer of the petitioner for directions to register an offence against respondent No.1 pursuant to complaint dated 13th May, 2021 cannot be allowed in BGP.

Once the petitioner was informed about non-disclosure of cognizable offence, it was open for the petitioner to approach before the Magistrate seeking order of investigation. 5.

Keeping such right of the petitioner in tact and reserved, we do not see any reason to cause interference in the matter. 6.

The petition as such stands disposed of with liberty as observed herein-above.
