This Application is for condonation of 48 days delay in filing the Civil Application to restore the First Appeal which stood dismissed in view of conditional order dated 12.06.2015 passed by this court for non filing of paper book.

The learned counsel for the Applicant submits inadvertently it remained on their part to file paper book in time. The Applicant undertakes to file the same within four weeks from today.

18.1.17-caf.odt Considering the submissions made by the learned counsel for the Applicant and the averments made in the Civil Application, I am satisfied that the Applicant has made out a case for allowing the Civil Application.

Hence, following order is passed:

a.

Delay in filing the Civil Application is condoned.

b.

Time to file paper book as per order dated 12.06.2015 is extended till 16.11.2019, with copy to other side.

c.

First Appeal is restored to file for hearing and final disposal on merits.

d.

The Civil Application stands disposed of accordingly.

e.

No order as to costs.
